Privacy Policy

NeedsDirt is operated by Hamilton Development Company, LLC (“NeedsDirt,” “we,” “our,” or “us”). This Privacy Policy explains how we collect, use, disclose, and protect information about you when you use needsdirt.com and any associated services, APIs, or mobile interfaces (collectively, the “Service”).

By using the Service, you agree to this Privacy Policy. If you do not agree, please do not use the Service.

1. Information We Collect

Account Information

When you register, we collect your name, email address, company name, and physical address (used to anchor your market and sort nearby listings).

Location Data

To sort listings by proximity, the Service requests access to your device’s location. Location is used solely to calculate distance between you and listings — it is not stored persistently on our servers beyond what is necessary to serve your current session. You may deny location access; listings will still be accessible but will not be distance-sorted.

Listing Content

Any listings you post — including descriptions, material types, quantities, site addresses, and photos — are stored on our servers and displayed to other registered users.

Payment Information

Payment processing is handled by Stripe, Inc. We do not store your full credit card number, CVV, or bank account details on our servers. We receive and store transaction identifiers, payment status, and the last four digits of your card for reference. Stripe’s privacy practices are governed by the Stripe Privacy Policy.

Subscription & Billing Data

We store your subscription tier, billing cycle, and payment history for account management and invoicing purposes.

API Usage

If you use the NeedsDirt Developer API, we collect API keys you generate, request logs (timestamps, endpoints, response codes), and IP addresses associated with API calls. This data is used for rate limiting, abuse prevention, and billing for BILLING-scoped keys.

Usage & Analytics

We use Google Analytics 4 (GA4) to collect aggregated usage data including pages visited, session duration, device type, and general geographic region. GA4 sets cookies and may transfer data to Google’s servers. You can opt out via the Google Analytics Opt-Out Browser Add-on.

Error Monitoring

We use Sentry to capture application errors. Error reports may include browser type, OS, page URL, and anonymized stack trace data. No personal identifiers are intentionally included in error reports.

Communications

If you contact us by email or through a feedback form, we retain those communications to resolve your inquiry and improve the Service.

2. How We Use Your Information

  • Provide, operate, and improve the Service
  • Sort listings by proximity to your location
  • Process payments and manage subscriptions via Stripe
  • Send transactional emails (account confirmation, payment receipts, listing activity)
  • Enforce our Terms of Service and prevent fraud or abuse
  • Analyze usage trends to improve the platform
  • Respond to your support requests
  • Comply with legal obligations

We do not sell your personal information to third parties. We do not use your data for targeted advertising.

3. Information Sharing

With Other Users

Your public listings (listing type, description, location, contact preferences) are visible to all registered users. Your name or company name may be displayed alongside your listings.

With Service Providers

We share data with third-party vendors who assist in operating the Service, including:

  • Stripe — payment processing
  • Google — analytics (GA4)
  • Sentry — error monitoring
  • Mailgun — transactional email delivery
  • Vultr / cloud hosting providers — infrastructure and storage

These vendors are contractually bound to use your data only to provide services to us and in accordance with applicable law.

Legal Disclosure

We may disclose your information if required by law, regulation, legal process, or governmental request; or to protect the rights, property, or safety of NeedsDirt, its users, or the public.

Business Transfers

If NeedsDirt or Hamilton Development Company, LLC is acquired, merged, or sells substantially all of its assets, your information may be transferred to the acquiring entity. You will be notified of any such change via email or a prominent notice on the Service.

4. Cookies

We use cookies and similar technologies for session management (keeping you logged in), security (CSRF protection), and analytics (GA4). You may disable cookies through your browser settings, but doing so may impair Service functionality.

5. Data Retention

We retain your account data for as long as your account is active. If you delete your account, we will delete or anonymize your personal information within 30 days, except where we are required to retain it for legal, tax, or fraud-prevention purposes. Listing content you posted will be removed or anonymized upon account deletion.

6. Your Rights

Depending on where you are located, you may have rights to:

  • Access — request a copy of the personal data we hold about you
  • Correction — request correction of inaccurate data
  • Deletion — request deletion of your personal data
  • Portability — receive your data in a structured, machine-readable format
  • Opt-out of analytics — use the GA4 opt-out tool linked above

7. Children’s Privacy

The Service is intended for use by businesses and contractors. We do not knowingly collect personal information from anyone under the age of 18. If we learn we have collected information from a minor, we will delete it promptly.

8. Security

We implement industry-standard technical and organizational measures to protect your data, including TLS encryption in transit, hashed password storage, and access controls on production systems. No method of transmission or storage is 100% secure; we cannot guarantee absolute security.

9. Changes to This Policy

We may update this Privacy Policy periodically. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated policy.
