NeedsDirt is operated by Hamilton Development Company, LLC (“NeedsDirt,” “we,” “our,” or “us”). This Privacy Policy explains how we collect, use, disclose, and protect information about you when you use needsdirt.com and any associated services, APIs, or mobile interfaces (collectively, the “Service”).

By using the Service, you agree to this Privacy Policy. If you do not agree, please do not use the Service.

1. Information We Collect

Account Information

When you register, we collect your name, email address, company name, phone number, and physical address and ZIP code (used to anchor your market and sort nearby listings). We also record whether you opted in to marketing email or text messages, when you did so, and which version of this policy was in force at the time.

Location Data

To sort listings by proximity, the Service requests access to your device’s location. Location is used solely to calculate distance between you and listings — it is not stored persistently on our servers beyond what is necessary to serve your current session. You may deny location access; listings will still be accessible but will not be distance-sorted.

Listing Content

Any listings you post — including descriptions, material types, quantities, site addresses, and photos — are stored on our servers and displayed to other registered users.

Payment Information

Payment processing is handled by Stripe, Inc. We do not store your full credit card number, CVV, or bank account details on our servers. We receive and store transaction identifiers, payment status, and the last four digits of your card for reference. Stripe’s privacy practices are governed by the Stripe Privacy Policy.

Subscription & Billing Data

We store your subscription tier, billing cycle, and payment history for account management and invoicing purposes.

API Usage

If you use the NeedsDirt Developer API, we collect API keys you generate, request logs (timestamps, endpoints, response codes), and IP addresses associated with API calls. This data is used for rate limiting, abuse prevention, and billing for BILLING-scoped keys.

Usage & Analytics

We use Google Analytics 4 (GA4) and Google Tag Manager to collect aggregated usage data including pages visited, session duration, device type, and general geographic region. GA4 sets cookies and may transfer data to Google’s servers. You can opt out via the Google Analytics Opt-Out Browser Add-on.

We also use PostHog for product analytics and session replay. Session replay records how pages are used — clicks, scrolling, navigation and the shape of form interaction — so we can see where the Service is confusing or broken. Text you type into form fields is masked and is not captured. Replays are stored by PostHog on our behalf and are not sold or shared.

Advertising Measurement

We advertise NeedsDirt on Meta (Facebook and Instagram), but we do not put Meta’s tracking pixel or any other advertising tag on this site. We measure our adverts with campaign tags in the link you clicked, which stay with us. Nothing about your visit is sent to an advertising platform, and we do not upload our user list to one.

Error Monitoring

We use Sentry to capture application errors. Error reports may include browser type, OS, page URL, and anonymized stack trace data. No personal identifiers are intentionally included in error reports.

Communications

If you contact us by email or through a feedback form, we retain those communications to resolve your inquiry and improve the Service.

2. How We Use Your Information

Provide, operate, and improve the Service
Sort listings by proximity to your location
Process payments and manage subscriptions via Stripe
Send transactional emails (account confirmation, payment receipts, listing activity)
Enforce our Terms of Service and prevent fraud or abuse
Analyze usage trends to improve the platform
Respond to your support requests
Comply with legal obligations
With your permission, send you marketing messages about our own products and services, and products and services we offer from partners — and use the trade, company and location details you gave us to decide which of those are worth showing you (see Section 3)

We do not sell or share your personal information. We do not rent, trade or hand your details to advertisers, partners, lead buyers or data brokers. If a partner’s product interests you, you reach them yourself — by clicking their link or dialling their number — and what you do from there is between you and them.

3. Marketing and Partner Offers

What we send

If you tick the marketing box when you create your account, we may email you tips, activity near you, and offers on tools and services useful to your business — both our own (including websites, marketing and software from Hamilton Development Company, LLC) and products and services we offer from partners. If you separately tick the text-message box and give us a phone number, we may text you; message and data rates may apply and you can reply STOP at any time.

Neither is required to use NeedsDirt. Everything on the Service works the same whether you tick them or not, and you can change your mind at any time using the unsubscribe link in any message or by emailing us.

Transactional messages are separate. Account confirmation, password resets, listing activity and receipts are part of the Service and are sent whether or not you opt in to marketing.

Affiliate links and referral payments

Some pages carry links or phone numbers for third-party services such as dumpster rental, hauling, junk removal or material delivery. If you use one, we may be paid a referral fee or a commission by that company. This costs you nothing and does not change what you are quoted. We label these clearly on the page where they appear.

Choosing to click a link or dial a number sends you to that company, and anything you then tell them is governed by their privacy policy, not ours. We do not pass them your details. We do not generate leads by handing over your contact information, and we do not sell enquiries.

4. Information Sharing

With Other Users

Your public listings (listing type, description, location, contact preferences) are visible to all registered users. Your name or company name may be displayed alongside your listings.

With Service Providers

We share data with third-party vendors who assist in operating the Service, including:

Stripe — payment processing
Google — analytics (GA4, Tag Manager), maps and address lookup
PostHog — product analytics and session replay
Sentry — error monitoring
Mailgun — transactional email delivery
GoHighLevel — customer records and, where you have opted in, marketing email and text messages
Vultr / cloud hosting providers — infrastructure and storage

These vendors process data on our instructions and are contractually bound to use it only to provide services to us and in accordance with applicable law. They are not permitted to use it for their own purposes, and none of them buys your information from us.

Legal Disclosure

We may disclose your information if required by law, regulation, legal process, or governmental request; or to protect the rights, property, or safety of NeedsDirt, its users, or the public.

Business Transfers

If NeedsDirt or Hamilton Development Company, LLC is acquired, merged, or sells substantially all of its assets, your information may be transferred to the acquiring entity. You will be notified of any such change via email or a prominent notice on the Service.

5. Cookies

We use cookies and similar technologies for session management (keeping you logged in), security (CSRF protection), and analytics (GA4 and PostHog). We use no advertising cookies. We also store campaign details in your browser’s local storage when you arrive from a link or advert, so that if you later create an account we know which campaign brought you. You may disable cookies through your browser settings, but doing so may impair Service functionality.

6. Data Retention

We retain your account data for as long as your account is active. If you delete your account, we will delete or anonymize your personal information within 30 days, except where we are required to retain it for legal, tax, or fraud-prevention purposes. Listing content you posted will be removed or anonymized upon account deletion.

7. Your Rights

Depending on where you are located, you may have rights to:

Access — request a copy of the personal data we hold about you
Correction — request correction of inaccurate data
Deletion — request deletion of your personal data
Portability — receive your data in a structured, machine-readable format
Opt-out of analytics — use the GA4 opt-out tool linked above
Opt-out of marketing — use the unsubscribe link in any marketing email, reply STOP to any text message, or email us. This does not affect transactional messages or your ability to use the Service

8. Children’s Privacy

The Service is intended for use by businesses and contractors. We do not knowingly collect personal information from anyone under the age of 18. If we learn we have collected information from a minor, we will delete it promptly.

9. Security

We implement industry-standard technical and organizational measures to protect your data, including TLS encryption in transit, hashed password storage, and access controls on production systems. No method of transmission or storage is 100% secure; we cannot guarantee absolute security.

10. Changes to This Policy

We may update this Privacy Policy periodically. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated policy.
